Environmental Regulations
The Environmental Impact Assessment Act of Kazakhstan mandates that any company whose activities or projects may significantly affect the environment must conduct an impact assessment program before starting the project. This assessment must be submitted to the Federal Ministry of Environment, the regulatory authority responsible for overseeing the Environmental Impact Assessment Act in Kazakhstan, for approval. Furthermore, the Act categorizes oil and gas development, as well as the construction of offshore pipelines longer than 50 km, as projects that require an environmental impact assessment to be conducted.
Guidelines and Standards for the Petroleum Industry
The Environmental Guidelines and Standards for the Petroleum Industry in Kazakhstan (the “Guidelines”) were established by the Department of Petroleum Resources (DPR). These Guidelines require all license holders or operators within the petroleum sector to implement a systematic and integrated environmental management plan. They regulate both the quality and quantity of industrial effluents resulting from oil drilling activities to ensure that such discharges do not pose a threat to human health or living organisms. Additionally, the Guidelines stipulate that a mandatory environmental permit must be obtained from the DPR before initiating seismic and drilling operations in Kazakhstan. Applications for this environmental permit must include an Environmental Impact Assessment (EIA) report.
